Terms and Conditions of Accommodation

Scope of Application

 

Article 1 The accommodation contract and related agreements entered into by this hotel with a guest shall be governed by the provisions of these general terms and conditions, and any matters not provided for in these general terms and conditions shall be governed by laws and regulations, etc. (meaning laws and regulations or those based on laws and regulations. The same shall apply hereinafter). (2) The Hotel shall not be liable for any loss or damage arising out of or in connection with the use of the Hotel’s facilities or services.

In the event that this hotel agrees to a special agreement to the extent that it does not contravene laws, ordinances, etc. and custom, such special agreement shall prevail notwithstanding the provisions of the preceding paragraph.

(Application for accommodation contract) Article 2.

 

Article 2 A person who wishes to apply for a contract of accommodation at this hotel shall provide the following items to this hotel

 

(1) Name of the guest

(2) Date of stay and estimated time of arrival

(3) Room charge (in principle, in accordance with the basic room charge in Appendix 1)

(4) Other matters deemed necessary by this hotel. 2.

In the event that the guest requests to continue his/her stay beyond the date of stay stipulated in item 2 of the preceding paragraph during the stay, this hotel shall treat such request as a new application for a contract of stay at the time such request is made, and the new advance deposit determined by this hotel shall be paid at that time.

 

 

Establishment of Accommodation Contract, etc.

Article 3 The accommodation contract shall be concluded when this hotel has accepted the application as described in the preceding article. However, this shall not apply when this hotel proves that it has not given its consent. 2.

– (2) When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, an advance deposit determined by this hotel shall be paid at the time of arrival or by the date designated by this hotel.

– In the event that the amount used for accommodation during the stay exceeds or is expected to exceed the amount of the deposit, an additional deposit of the amount determined by this hotel will be charged by the time designated by this hotel. In the event that the deposit is not received by the time designated by this hotel, this hotel reserves the right to cancel the accommodation contract in accordance with the provisions of Article 7, Paragraph 1, Item 1. 4.

– In the event that the provisions of Articles 6 and 17 apply, the advance received and the additional deposit shall first be applied to the room charge ultimately payable by the guest, followed by the penalty and then the compensation, and any remaining amount shall be returned at the time of payment of the charges pursuant to Article 12.

– In the event that the advance payment as stipulated in paragraph 2 is not paid upon arrival or by the date designated by this hotel despite prior notice and request by this hotel, the accommodation contract shall cease to be effective.

(Special agreement not to require advance deposit payment) Article 4.

Notwithstanding the provisions of Article 4, paragraph 2, this hotel may accept a special agreement not to require payment of the advance deposit as stipulated in the same paragraph after the contract is concluded, if a travel check, room voucher, credit card, or any other method that can substitute for currency is presented and validated, and other necessary procedures are completed.

– In the event that this hotel does not request payment of the advance deposit as stipulated in paragraph 2 of the preceding article or does not specify the date for payment of said advance deposit upon acceptance of the application for accommodation contract, it shall be deemed that this hotel has complied with the special agreement stipulated in the preceding paragraph. 3.

– 3. request for cooperation in measures to prevent infectious diseases at the facility The hotel may request the person who intends to stay at the hotel to cooperate in accordance with the provisions of Article 4-2, Paragraph 1 of the Ryokan Business Law (Law No. 138, 1948).

(Refusal to enter into an accommodation contract) Article 5.

Article 5 This hotel may refuse to conclude an accommodation contract in the following cases. However, this paragraph does not mean that this hotel may refuse to accommodate guests in cases other than those listed in Article 5 of the Ryokan Business Law.

– (1)When an application for accommodation is not in accordance with these General Terms and Conditions.

– (2) When there is no room available due to full occupancy.

– (3) When it is recognized that the person who intends to stay at the hotel is likely to conduct himself/herself in a manner that is contrary to the Terms and Conditions of Accommodation (= these terms and conditions), provisions of laws and regulations, public order, or good morals in connection with the accommodation.

– (4)When a violent act of demand is committed or a burden exceeding a reasonable extent is demanded in connection with the accommodation. (5) When a person who intends to stay at the hotel has violated the Act on Promotion of Elimination of Discrimination on the Basis of Disability (Act No. 65 of 2013. The Act on the Elimination of Discrimination against Persons with Disabilities) Article 7, paragraph 2 or Article 8, paragraph 2).

– (5)When a person who intends to stay at the hotel repeatedly makes a request to the hotel that is so burdensome in its implementation that it may seriously impede the provision of accommodation-related services to other guests, as specified in Article 5-6 of the Enforcement Regulations of the Ryokan Business Law.

– (6)When the accommodation cannot be made available due to a natural disaster, a breakdown of the facilities, or other unavoidable reasons.

– (7) When a person who intends to stay at the inn is intoxicated, or when his/her speech or behavior is extremely abnormal and deemed likely to cause inconvenience to other guests. (Article 4 of the Kanagawa Prefecture Ryokan Law Enforcement Regulations)

– (8) When a person who intends to stay at the accommodation has falsified the information provided at the time of application for accommodation.

– (9) When a person who intends to stay at the inn is considered to be extremely unclean in body or clothing, and is likely to cause inconvenience to other guests. (Kanagawa Prefecture Ryokan Law Enforcement Ordinance, Article 4)

– (10) When this hotel otherwise deems it unreasonable to allow the guest to stay overnight.

(2) In the following cases, this hotel will not conclude a contract of accommodation

– (1) When the person seeking accommodation is a member of a crime syndicate, a group related to crime syndicates or other anti-social forces.

– (2) When the person who intends to stay at the hotel is related to a crime syndicate or a corporation or other organization whose business activities are controlled by a crime syndicate or a crime syndicate member.

– (3)When a person who intends to stay at the hotel is a patient, etc. of a specified infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Ryokan Business Law (hereinafter referred to as “patient, etc. of specified infectious disease”). 3. when the person seeking accommodation is a patient, etc. of a specified infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Inn Business Law (hereinafter referred to as “patient, etc. of specified infectious disease”).

  1. explanation of refusal to conclude a contract of accommodation

A person who intends to stay at the hotel may request this hotel to explain the reasons for its refusal to enter into a contract of accommodation in accordance with the preceding article.

(The guest’s right to cancel the contract)

Article 6 The guest may cancel the accommodation contract by notifying this hotel. 2.

In the event that the guest cancels all or part of the accommodation contract for reasons attributable to the guest (except in the event that this hotel has designated a date for payment of the advance deposit and requested payment thereof pursuant to Article 3, paragraph 2, and the guest has cancelled the accommodation contract prior to such payment), this hotel shall notify the guest in accordance with the provisions listed in appended table 2. ), a penalty charge will be assessed in accordance with the provisions listed in Appended Table 2. However, in the event that this hotel accepts the special contract stipulated in Article 4, Paragraph 1, it is only when this hotel, in accepting the special contract, notifies the guest of the obligation to pay the penalty when the guest cancels the accommodation contract. 3.

In the event that the guest does not arrive at the hotel by 8:00 p.m. on the day of the stay (or 2 hours after the estimated time of arrival, if such time has been specified in advance), this hotel may deem the accommodation contract to have been cancelled by the guest and treat the same as if the contract had been cancelled.

(Right of this hotel to cancel the contract) Article 7.

Article 7 This hotel may cancel the accommodation contract in the following cases. However, this paragraph does not mean that this hotel may refuse accommodation in cases other than those listed in Article 5 of the Ryokan Business Law.

– (1)When it is recognized that the guest is likely to commit an act contrary to the Terms and Conditions of Accommodation (= these terms and conditions), legal provisions, public order, or good morals in connection with the accommodation, or when it is recognized that the guest has committed such an act.

– (2) When a violent act of demand is committed or a burden exceeding a reasonable range is demanded in relation to the accommodation. (except when the guest requests the removal of social barriers pursuant to the provisions of Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on Elimination of Discrimination against Persons with Disabilities).

– (3)When a guest repeatedly makes a request to this hotel that is so burdensome in its implementation that it may seriously impede the provision of services related to accommodation to other guests, as stipulated in Article 5-6 of the Enforcement Regulations of the Ryokan Business Law.

– (4) When a guest cannot be accommodated due to a force majeure such as a natural disaster.

– (5) When a guest is intoxicated, or his/her speech or behavior is extremely abnormal, and it is recognized that there is a risk of causing inconvenience to other guests. (Article 4 of the Kanagawa Prefecture Ryokan Law Enforcement Regulations)

– (6) When the guest has falsified the information provided at the time of application for accommodation or the information registered at the time of registration for accommodation.

– (7)When it is recognized that the person who intends to stay at the inn is extremely unclean in body or dress and is likely to cause inconvenience to other guests. (Kanagawa Prefecture Ryokan Law Enforcement Ordinance, Article 4)

– (8) When a guest does not comply with any other prohibitions in the rules of use established by this hotel.

(2) In the following cases, this hotel will cancel the accommodation contract

– (1) When the guest is a member of a crime syndicate, a crime syndicate, a group related to crime syndicates, or any other anti-social force.

– (2) When the guest is related to a crime syndicate or a corporation or other organization whose business activities are controlled by a member of a crime syndicate.

– (3) When the guest is a patient with a specified infectious disease, etc.

(3) When this hotel cancels the accommodation contract pursuant to the provisions of paragraph 1 or 2, the hotel will not charge the guest for accommodation services, etc. that have not yet been provided.

Explanation of Cancellation of Accommodation Contract

In the event that this hotel cancels the accommodation contract in accordance with the preceding Article, the guest may request an explanation of the reasons for such cancellation.

In the event that this hotel (kan) cancels the accommodation contract in accordance with the preceding article, the guest may request an explanation of the reason for such cancellation.

 

Accommodation Registration

The guest shall register the following items at the front desk of this hotel on the day of stay.

 

– (1) Name, address and occupation of the guest

– (2) Nationality and passport number in the case of a foreigner who does not have a domicile in Japan

– (3) Any other information deemed necessary by this hotel. 2.

(2) If the guest wishes to pay the charges in accordance with Article 12 by means of a traveler’s check, room voucher, credit card, or other means that can substitute for currency, the guest must present the check to this hotel at the time of registration in the preceding paragraph, and must confirm its validity and go through other necessary procedures.

(Hours of use of guest rooms) Article 9.

Article 9 Guests may use a guest room at this hotel from 3:00 p.m. to 11:00 a.m. of the following day. However, in the case of a consecutive stay, the guest may use the room for the entire day, except for the day of arrival and the day of departure. 2.

Notwithstanding the provisions of the preceding paragraph, the hotel may accept the use of a room outside the hours specified in the preceding paragraph. In such cases, the following additional charges shall apply

– (1) 30% of the room charge for up to 3 hours in excess

– (2) 50% of the room charge for up to 6 hours in excess

– (3) For more than 6 hours in excess, the full amount of the room charge will be charged.

Compliance with the Rules of Use

Guests shall abide by the rules of use established by the hotel and presented in the hotel.

Business hours

Detailed information on the business hours of the facilities, etc. shall be provided in the pamphlet provided, notices posted in various places, and in the service directory in the guest room, etc.

The above-mentioned contents may be changed temporarily if necessary or unavoidable. In such cases, notification will be provided by appropriate means.

Payment of charges

The breakdown of accommodation charges, etc. to be paid by the guest and the method of calculation thereof shall be as shown in Appended Table 1. 2.

(2) Payment of the accommodation charge set forth in the preceding paragraph shall be made at the front desk upon arrival of the guest or when requested by this hotel, in the currency designated by this hotel or by a method acceptable to this hotel in lieu of currency, such as a travel check, room voucher, or credit card, except as otherwise provided for in Article 4, Clause 1 of the Accommodation Agreement.

The room charge shall be collected even if the guest voluntarily does not stay at the hotel after the hotel has provided the room to the guest and made it available for his/her use.

Responsibility of this hotel

In the event that this hotel causes damage to a guest in the performance or non-performance of the accommodation contract and related agreements, this hotel shall compensate for such damage. However, this shall not apply when the damage is not attributable to reasons attributable to this hotel. 2.

The hotel has Ryokan liability insurance to cover any fire, etc., that may occur.

(Treatment in the event that the hotel is unable to provide the contracted guest room) Article 14.

In the event that this hotel is unable to provide the contracted guest room, this hotel shall, with the consent of the guest, mediate other accommodations under the same conditions as far as possible. 2.

In the event that this hotel is unable to arrange other accommodation notwithstanding the provisions of the preceding paragraph, this hotel shall pay the guest a compensation fee equivalent to the amount of the penalty, and such compensation fee shall be applied to the amount of compensation for damages. However, if there is no reason attributable to this hotel for not being able to provide a room, no compensation shall be paid.

(Handling of Deposited Articles, etc.) Article 15.

Article 15 In the event of loss, damage, etc. to articles left at the front desk by a guest, this hotel shall compensate for such damage, except in cases where such damage is caused by force majeure. However, in the event that the articles deposited by the guest are cash or valuables, this hotel shall not compensate for any damage if the type and value of the articles are not disclosed by the guest. 2.

This hotel will not compensate for any damage to articles brought into the hotel by the guest and not left at the front desk, unless the loss or damage is caused by the intentional or negligent fault of this hotel. Even in the event that this hotel is liable for compensation, this hotel will compensate for damages up to 150,000 yen for items for which the type and value have not been disclosed by the guest in advance. This hotel will not compensate for any cash or valuables not left at the front desk.

Custody of guest’s baggage or personal belongings

In the event that a guest’s baggage arrives at this hotel prior to his/her stay, this hotel shall take responsibility for its safekeeping only if it is agreed upon by this hotel prior to arrival, and shall deliver it to the guest when he/she checks in at the front desk. 2.

In the event that a guest’s baggage or personal belongings are left at the hotel after the guest has checked out, the hotel will take any action deemed appropriate by law. If the owner of such baggage or personal belongings is clearly identified, this hotel may (but is not obliged to), at its discretion, contact the owner and request instructions from him or her. 3.

The responsibility of this hotel for the custody of the guest’s baggage or personal belongings in the case of the preceding two paragraphs shall, in the case of paragraph 1, conform to the provisions of paragraph 1 of the preceding article, and in the case of the preceding paragraph, to the provisions of paragraph 2 of the same article.

(Liability of the guest) Article 17.

In the event that this hotel suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this hotel for such damages.

Disclaimer

The guest shall be responsible for his/her own use of the Internet, e-mail, and other communications from this hotel via personal computer, cellular phone, etc. The guest shall be responsible for his/her own use of such communications. The Hotel shall not be liable for any damage incurred by the user as a result of system failure, radio wave failure, power outage, or any other reason during the use of such communications. In addition, if the Hotel or a third party suffers any damage as a result of any act that the Hotel deems inappropriate prior to or after the fact when using such communications, the Hotel shall be liable to compensate for such damage.

Language

These Terms and Conditions shall be written in Japanese as the original language and in English as the translated language. The English translation is only to be used as a reference for the Japanese original, and the Japanese version shall prevail in all cases.

Jurisdiction and Governing Law

Any and all disputes arising from the accommodation contract, etc. under these Terms and Conditions shall be subject to the exclusive jurisdiction of the summary court or district court of first instance, depending on the amount of the suit, among the courts having jurisdiction over the location of the Hotel. 2.

These terms and conditions shall be governed by and construed in accordance with the laws of Japan.

– 1. % is the ratio of the penalty charge to the basic room charge. 2.

– In the event that the contracted number of days is shortened, a penalty of one day (the first day) will be charged regardless of the number of days shortened. 3.

– In the event that a part of a group (10 or more persons) cancels the contract, 10% of the number of persons staying at the hotel 10 days prior to the stay (or the date of acceptance of the reservation if the reservation is accepted after that date) (any fractional number will be rounded up) will be charged as the penalty fee. No penalty will be charged for the number of guests that is equal to 10% (rounded up to the nearest whole number) of the number of guests staying at the hotel 10 days prior to the date of cancellation (or the date of acceptance if the reservation is accepted after that date).

 

Rules of Use

Terms and Conditions of Use

In order to ensure the safety and comfort of all our guests, please observe the following rules as stipulated in Article 10 of the Accommodation Agreement. Failure to abide by these rules may result in the cancellation of the accommodation contract and related agreements, in accordance with Article 7 of the Accommodation Agreement.

Items to be observed for fire prevention

(1) Smoking is not permitted in areas prone to fire, such as in beds, or in areas other than smoking areas.

Do not hang towels, clothes, etc. over light fixtures. 3.

Do not touch fire-fighting equipment except in case of emergency. 4.

Do not bring into the hotel any fire, such as for heating or cooking, explosives, volatile oil, or other flammable or combustible materials. 5.

(5) Please check the evacuation route map from the guest room on the back side of the guest room entrance door.

Security precautions to be taken

Please do not bring the following items into the hotel

– a. Dogs, cats, birds and other pets

– b. Items that emit foul or unusual odors

– c. Dangerous items such as gunpowder or volatile oil that can easily ignite or catch fire

– d. Other items prohibited by law

Please make sure that the door is locked when you leave the room. Please make sure that the door is locked when you leave the room, especially when you are sleeping. 3.

If you have a visitor, please do not open the door carelessly, but check the door scope or open the door half-open with the door arm latched (if you think someone is suspicious, please open the door half-open).

Please refrain from the following activities

Please do not engage in gambling or any other conduct that may disturb public morals in the hotel. 2.

Do not shout, sing, or behave in a boisterous manner that may disturb other guests in the hotel. 3.

Do not use the guest rooms for any purpose other than lodging, eating and drinking without the permission of the hotel. 4.

Please do not bring food and beverages into the hotel, or have them delivered from outside. 5.

Please do not move any of the hotel’s facilities or goods to another location or otherwise alter their condition without the hotel’s permission. 6.

(6) Please do not display any items that detract from the appearance of the hotel by the windows.

No persons other than those registered to stay in the hotel are allowed to stay in the hotel. Please do not invite guests from outside to stay in your room. 8.

  1. please do not distribute or display advertising materials or solicit sales of goods in the hotel without the hotel’s permission. 9.

Please be aware that public display of photographs taken in the hotel for business purposes without permission may result in legal action. 10.

  1. please do not wear yukata, pajamas, slippers, etc. in the corridors or outside of the rooms.

Payment Policy

When using the restaurants, bars, etc. in the hotel with your signature, please present your room key or room card. However, there may be cases where the hotel notifies guests in advance that they are not allowed to use the restaurant or bar with their signatures, or where the hotel reserves the right to refuse such use. 2.

(2) We will not be able to replace the cost of purchases, tickets, cab fares, etc. (3) Please note that the hotel will not be able to replace the cost of any items that are not included on the guest’s room bill.

(3) Unless otherwise stipulated in Article 4, Clause 1 of the General Terms and Conditions of Accommodation, guests are required to pay the deposit determined by the hotel at the time of arrival or by the date specified by the hotel.

(4) Please pay the invoice each time it is presented by the front desk, even during your stay.

Payment must be made at the front desk in the currency specified by the hotel or by traveler’s check, voucher, or credit card accepted by the hotel. Please note that we do not accept checks other than traveler’s checks or currency exchange. 6.

  1. a service charge of 10% of the total bill will be added to the bill in addition to the prescribed tax. Please note that we do not accept any gratuities for our employees.

Valuables and Checked-in Items

  1. please keep your valuables such as cash and precious metals in the safe provided in your room or deposit them in the safe deposit box (free of charge) at the front desk.
  2. the hotel will take appropriate measures in accordance with laws, regulations, and terms and conditions for any unclaimed or left behind items.

Others

(1) Minors are not allowed to stay at the hotel without the permission of their parents or guardians.

(2) In the event of defacement or loss of buildings, furniture, fixtures, or other items due to reasons other than force majeure, the guest may be required to pay a reasonable amount of compensation. (3) In the event of loss of the key to the room, the guest may be required to pay a reasonable amount of compensation.

If the key to your room is not returned due to loss, etc., you will be charged the actual cost of the key. 4.
